Legal professionals must exercise particular caution when assisting LGBTQ individuals, especially in cases involving the Anti-Homosexuality Act of 2023 or Sections 145 and 146 of the Penal Code Act in Uganda. In these cases, the burden of proof lies with the accuser to demonstrate that a sexual act was indeed committed. For attempted acts, it must be proven beyond a reasonable doubt that the suspect had the intention to commit a sexual act.
It is also important to note that prosecutors may opt for charges unrelated to the individual's sexuality. Many cases related to homosexuality have proven to be politically motivated, with the intention being to persecute the individual rather than to seek justice. Legal professionals must therefore be vigilant and ensure that the rights of LGBTQ individuals are protected, and that justice is served fairly and impartially.
